The Worker Protection (Amendment of Equality Act 2010) Act received Royal Assent on 26 October 2023.

This Act, which introduces a duty on employers to take reasonable steps to prevent sexual harassment of their employees in the workplace, will come into force in October 2024.

The Worker Protection (Amendment of Equality Act 2010) Act 2023 will place all employers under a statutory duty to take reasonable steps to prevent sex harassment in the workplace.

Failure to comply with the duty may result in enforcement steps by the Equality and Human Rights Commission and employment tribunals will have the power to increase compensation by up to 25% The new duty is in addition to the employee’s right to be protected from sexual harassment under the Equality Act 2010.
